What Information Is Included in a SAP Report?

The Initial Evaluation Report
The initial evaluation report must be on the SAP's own letterhead, signed, and dated. It must include:
- The employee's name and Social Security number or employee ID
- The employer's name and address
- The reason for the assessment, including the specific DOT violation and its date
- The date(s) and format (face to face or remote) of the assessment
- The SAP's education or treatment recommendation
- The SAP's phone number
The Follow Up Report Finding Successful Compliance
When the SAP finds successful compliance, the follow up report must include:
- The employee's name and ID, and the employer's name and address
- The reason for the initial assessment
- The date(s) and format of the initial assessment, and a synopsis of the treatment plan
- The name of the practice or service that provided education or treatment
- The inclusive dates of program participation
- A clinical characterization of the employee's participation
- The SAP's determination of successful compliance
- The follow up testing plan
- Continuing care needs or recommendations
- The SAP's phone number
The Follow Up Report Finding Non-Compliance
When the SAP finds the employee did not successfully comply, the report includes similar background items, plus the dates of the first follow up evaluation, the dates of any further scheduled follow up, and the SAP's clinical reasons for the non-compliance finding. 49 CFR § 40.311(e)
How Reports Move Between Parties
The SAP must send written reports directly to the employer's DER, not through a third party for forwarding, though the SAP may send the report simultaneously to the DER and to a C/TPA. The employer must receive its report directly from the SAP, unaltered by anyone in between. 49 CFR § 40.311(a)-(b) If an employee has no current employer, or obtains a new DOT regulated employer, the SAP must also provide reports directly to the employee or to that new employer as applicable. 49 CFR § 40.311(f)

In my experience, employees and DERs are sometimes surprised by how specific and structured these reports are. That level of detail exists so an employer's decisions about safety sensitive duty rest on documented clinical findings rather than a general impression relayed secondhand.
Common Misconceptions
Misconception
A SAP report includes detailed clinical notes about everything discussed in the evaluation.
Reality
The report is limited to the specific items required by regulation: identifying information, dates and format of the assessment, the recommendation or compliance determination, and related administrative details. It is not a full clinical record. 49 CFR § 40.311
Why the Confusion Occurs
Because the SAP evaluation is clinical in nature, people sometimes assume the report shares the same depth as a therapy record. The regulation intentionally limits what goes to the employer.
Frequently Asked Questions
Can my employer see my full clinical file?
No. The employer receives the structured report described above, not the SAP's underlying clinical records. The SAP separately maintains clinical records under applicable law. 49 CFR § 40.311(g)
Who else might receive a copy of my SAP report?
Depending on your situation, a copy may also go to a C/TPA the SAP sends simultaneously with the DER, or to you directly if you have no current employer, or to a new DOT regulated employer if you take a new safety sensitive position. 49 CFR § 40.311(f)
